The Telephone Consumer Protection Act makes leaving electronic messages on your cell phone or home phone illegal if you have not had a business relationship with the company calling you. If you are getting these calls on someone else’s account, do not erase messages that are left. Call me immediately and I can help you preserve them. The TCPA imposes a monetary penalty on the caller for each such call. Unfortunately, without the messages, collectors deny ever having called you. The messages are the best evidence.
Further, if someone is trying to make you pay on an account that is not yours, or just keeps calling you on someone else’s account after you have told them that they have the wrong phone number, you may be entitled to money damages.
